De heropening van Full Tilt Poker is gisterenavond weer een stap dichterbij gekomen. De Bernard Tapie Group heeft een deal gesloten met het Department of Justice waarbij zij voor $80 miljoen eigenaar worden van alle in beslag genomen activa. Zodra twee derde van de huidige aandeelhouders akkoord gaat met deze deal dan is Full Tilt Poker binnenkort officieel van de Groupe Bernard Tapie.

Embargo en verklaringen

Het nieuws kwam gisterenavond onverwachts naar buiten. Diverse media hadden het nieuws al met een embargo op de plank liggen, echter was men bij Yahoo Finance dat vergeten. Officiële verklaringen van alle betrokken partijen moesten dus eerder dan gepland naar buiten gebracht worden:

"We have an executed letter agreement with the Department of Justice that would allow GBT to purchase the Full Tilt assets from the United States. This is the first step in a process that will require agreement of the Full Tilt companies to the forfeiture of those assets and execution of a definitive agreement with the Department."

The historic agreement between DOJ and GBT lays out the terms of sale, requires GBT to reimburse ROW players, and details the procedure proposed to reimburse US players. But there is still work to do and of course important questions remain. When will the assets be forfeited and how quickly will the players be reimbursed? As answers to these questions become clearer, I anticipate you will receive further announcements from the parties to the transaction.

Verklaring van Full Tilt Poker en Ray Bitar aan PokerStrategy:

Full Tilt Poker is pleased that the terms of the agreement between Groupe Bernard Tapie (GBT) and the Department of Justice have been finalized, and that the agreement provides for GBT to repay or make whole players outside of the United States and for the Department of Justice to permit United States players to request compensation out of the forfeited funds. Since Black Friday, repaying customers has been FTP's number one priority.

Now that the agreement with DOJ has been reached, GBT and Full Tilt Poker will now turn to memorializing the final terms of their agreement, to bring this matter to a complete resolution as soon as possible.

Full Tilt Poker would like to thank all its customers for their continued patience since Black Friday and during this negotiation process.

Betalen van spelers en civiele rechtszaken

Zoals al eerder op 6 november bekend werd, is het Department of Justice met deze deal verantwoordelijk geworden voor het terugbetalen van de Amerikaanse speler. De Groupe Bernard Tapie is verantwoordelijk voor alle andere (Europese) spelers.

Geen van de huidige aandeelhouders zal in de toekomst aandeelhouder kunnen zijn van Full Tilt Poker. Lederer, Fergusson, Furst en Bitar zullen dus niet meer in de melk te brokkelen hebben, en dat is maar goed ook.

Onderdeel van de deal is dat het DoJ alle aanklachten tegen de ondernemingen waaruit Full Tilt Poker bestaat zal laten vallen. De persoonlijke aanklachten tegen de hoge heren van Full Tilt Poker die er zo'n zooi van gemaakt hebben blijven wel staan. Zij zullen overigens niet in eigen persoon zich moeten verantwoorden, eerder deze week dienden allen een zogenaamde "waiver of service" in, wat inhoudt dat zij lijfelijk niet aanwezig hoeven te zijn.

Toekomst

In de nabije toekomst zal Full Tilt Poker dus weer online komen en starten met een zeer lastige opgave, het vertrouwen terug winnen van de Europese pokerspelers. Dit zal hoogstwaarschijnlijk gaan door middel van veel acties en grote bonussen. Uit een vraag & antwoord topic op 2+2 van enkele weken terug waarin oud medewerkers van Full Tilt Poker vragen van spelers beantwoorden bleek dat niemand op kantoor iets aan het doen was buiten de marketing afdeling waar men druk bezig was met acties en promoties bedenken voor als de site weer online mocht.

De toekomst voor de Amerikaanse spelers ziet er toch minder rooskleurig goed uit. Zij zullen in een lang traject terecht komen waarbij ze via het Department of Justice hun geld zullen moeten terugvragen. De belastingdienst zal zeer waarschijnlijk ook een partij zijn in dit proces. Mochten er spelers zijn die hun pokerwinsten nooit eerder opgegeven bij de IRS hebben dan wordt het nog een zure appel.
